Under Title 14 of the Code of Federal Regulations (14 CFR § 91.3(a)):
“The pilot in command of an aircraft is directly responsible for, and is the final authority as to, the operation of that aircraft.”
All data tables, atmospheric models, crosswind calculations, fuel burn estimates, and reference materials published on Aeroway.org are supplementary technical references provided strictly for educational study, ground school reference, and preliminary planning checks. They are not certified operational flight dispatch tools.
1. Absolute Precedence of the Pilot’s Operating Handbook (POH / AFM)
Every aircraft is governed by its specific, serialized, FAA- or national aviation authority-approved Pilot’s Operating Handbook (POH), Airplane Flight Manual (AFM), Weight and Balance Data Sheet, and applicable Supplemental Type Certificates (STCs).
In any circumstance where data, approximations, or outputs derived from Aeroway.org conflict with, deviate from, or contradict the manufacturer’s approved POH/AFM for the specific aircraft tail number being operated, the official POH/AFM shall unequivocally govern and supersede Aeroway.org in all respects.
2. Acceptance of Terms
By accessing, reading, or referencing Aeroway.org (the “Site”), you acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service. If you do not agree with any provision contained herein, you must immediately discontinue use of this portal.
3. Non-Certified Electronic Flight Bag (EFB) Status
Aeroway.org is an open educational web portal. It is not an FAA AC 120-76 authorized Type A or Type B Electronic Flight Bag software application, nor is it an ICAO Annex 6 compliant flight dispatch system. Pilots must obtain official weather briefings via Flight Service (1800wxbrief.com), certified aviation weather sources (aviationweather.gov), and approved flight planning systems prior to all flights pursuant to 14 CFR § 91.103 (Preflight Action).
4. “AS IS” Status and Disclaimer of Warranties
THE PLATFORM, INCLUDING ALL STATIC TABLES, ALGORITHMIC OUTPUTS, FORMULAS, AND REFERENCE MATRICES, IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permissible under applicable law, Aeroway.org and its contributors disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular aeronautical purpose, title, accuracy, and non-infringement. We do not warrant that calculations will be error-free or uninterrupted.
5. Limitation of Liability & Indemnification
In no event shall Aeroway.org, its contributors, editors, developers, or affiliates be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, aircraft damage, loss of pilot license, regulatory enforcement actions, personal injury, loss of life, or commercial interruption) arising in any way out of the use of, or inability to use, this site or reliance upon any calculation or reference table published herein.
You agree to indemnify, defend, and hold harmless Aeroway.org from any claims, liabilities, damages, or expenses arising from your operation of an aircraft or your interpretation of aeronautical regulations.
6. Intellectual Property & Statutory Domain
Governing mathematical laws, equations of atmospheric physics, and public United States Federal Aviation Regulations are in the public domain. The unique compilation, user interface architecture, static data schemas, design system, and editorial commentary of Aeroway.org are protected by copyright and intellectual property laws.
